The Academy of Continuing Legal Education presents a program June 6, 2012, Wednesday. This program will provide information on procedural requirements of Ohio foreclosure law, and an update on Federal and Ohio programs designed to mitigate foreclosure effects. This program has been approved by the Supreme Court of Ohio, Office of CLE, for 6.5 hours of CLE credit. Additionally, the Accountancy Board of Ohio has now approved the Academy of Continuing Legal Education as a provider for CPA Continuing Education credit. A certificate for up to five hours of CE will be issued for attendance at the indicated sections. The program includes:
Special Procedural Characteristics of Foreclosure, Partition, Ejectment, and Quiet Title Litigation discussing requirements for initiating and litigating special real estate actions, and mechanisms for settling litigation. This material will be presented by Michelle Peņa, Esq. who has served as a foreclosure magistrate in the Lorain County Court of Common Pleas since 2008 and who designed that Court's local rules for foreclosure proceedings. (1.5 hour attorney CLE and 1.5 hour CPA CE)
The Predatory Lending, Enforcing Ohio Consumer Sales Practices Act in Foreclosure Cases, and National Settlement with Financial Institutions section is presented by Jeffrey Loeser, Esq., Assistant Ohio Attorney General in the Consumer Protection section. Mr. Loeser represented the State of Ohio in the negotiations leading to the nationwide State Attorney Generals settlement with major financial institutions, and has been a litigator in State v. GMAC and other actions by the Attorney General to enforce the OCSPA involving mortgage servicing entities. (1.5 hour attorney CLE and 1.5 hour CPA CE)
County Land Bank - Structure, Operation, Financing is presented by Dennis Roberts, Esq., the Director of Programs and Property Management of the Cuyahoga Land Re-Utilization Corporation, formerly the Cuyahoga County Land Bank. This will include descriptions of the statutory authority for creating a Land Bank, structures which may be used for operations, and sources of funding for operations.(1.0 hour attorney CLE and 1.0 hour CPA CE)
Ethics for Debt Collectors and Debt Avoiders is presented by Frank Veneziano, Esq., managing partner of the Cincinnati office of Weltman Weinberg & Reis. This discusses the Federal Fair Debt Collection Practices Act from the perspective of Rules of Professional Conduct 4.1, 4.2, 4.3, and 4.4, and has been approved by the Office of CLE to fulfill the mandatory Ethics hour requirement. (1.0 hour attorney CLE Ethics and 1.0 hour CPA CE) Professionalism: Foreclosure Impact on Non-Parties, also presented by Mr. Veneziano, has been approved by the Office of CLE to fulfill the mandatory Professionalism hour requirement. The Substance Abuse video prepared by Judge Kenneth R. Spanagel of the Parma Municipal Court will be offered as an option without additional charge. A course outline is available here.

Price for the six and one-half hours of CLE is $215.00, being $35.85 per credit hour with the SA complimentary, for reservations paid before May 30, 2012. Late registrations, received on or after May 30, are $240.00, to cover the expense of reproducing additional sets of the course materials at an expedited cost.
A discounted Early Registration fee is available for attorneys and non-attorney public officials representing small-county governments, described online here.
The Registration fee includes electronic reporting of CLE attendance to the Supreme Court of Ohio, Commission on Continuing Legal Education, and, if requested, a certificate for CPA CE credit. If an attendee requests additional communications or documents to enable that attendee to apply for credit for attending this program with any other State or agency, there is an administrative charge of $50.00 per other State or agency for which communications or documents are requested.
